“Claim Proceedings”: A Binary Online Class for DSUIA Cadets

The class focused on key aspects of claim proceedings, their formalization, and specific applications in legal practice.

The session was organized by police captain Maryna Lohinova, lecturer of the Department of Civil Law Disciplines at the Faculty for the Training of Specialists for Criminal Police Units of the National Police of Ukraine.

The guest speaker was attorney Anastasiia Zhornyak, who addressed the concept and essence of claim proceedings, emphasizing the definition and types of claims, as well as the procedure and grounds for securing a claim and counter-security. The mechanisms of applying such measures and the issue of compensation for damages caused by their application were discussed in detail.

A separate section was devoted to statements on the merits of the case, particularly the structure, content, and form of a statement of claim, along with the list of documents to be attached. The stages of filing a claim were examined, including grounds for returning a claim, leaving it without movement, or refusing to open proceedings. The opening of proceedings and preparatory proceedings were also discussed.

Special attention was paid to the procedural rights of the defendant, including submitting a response, objections, and counterclaims. The session also covered the features of the preparatory hearing, the procedure for issuing court rulings at this stage, and the mechanisms for dispute settlement with the participation of a judge.

Cadets learned about the possibility of the plaintiff withdrawing the claim, the defendant admitting the claim, concluding a settlement agreement, and the timeframes for considering the case on the merits. Additional topics included participation in court hearings via videoconference, examination of evidence, court debates, decision-making, and the process of court session recording.

The session concluded with a discussion of the grounds for suspending, closing proceedings, or leaving the claim without consideration, as well as the specific features of proceedings in cases related to the recognition of assets as unjustified and their recovery.

Involving legal practitioner Anastasiia Zhornyak in the educational process significantly enhanced the cadets’ understanding of the topic, as evidenced by their successful completion of the practical task on “Claim Proceedings”.
