The event was organized by the lecturer of the department of civil-legal disciplines of the faculty of training specialists for criminal police units of the NPU Captain of Police Marina Loginova.
With a report performed cadet of the third year Yuliia Tolmachova. She emphasized attention on the right of every person to receive effective restoration of their rights by a competent national court in case of violation of her basic rights provided by the constitution or national legislation.
Cadet Dmytro Prysiak raised a discussion question regarding the effectiveness of implementation of the right to judicial protection in procedural order in civil proceedings, which is associated with moral-psychological experiences, monetary expenses related to conducting a court case that stretches over a long term, presence of uncertainty of possible final result in resolving the case, absence of real criteria in protection and execution of court decision, objectivity of the court, legality and justification of court decision, etc.
To the discussion of the topic joined cadet Angelina Stepanenko and emphasized attention on the fact that among some criteria of improper attitude to judicial protection related to procedural terms, in her opinion, can be highlighted: non-compliance with procedural terms of consideration and resolution of the case; deliberate delay of the court process through the fault of the court representative; insufficient qualification of judges and other. According to the speaker, this is not a complete list of criteria, however ways of solving such an important issue are quite relevant and voluminous.
Participants shared their thoughts, expressed proposals regarding the necessity of improvement of civil procedural legislation and judicial practice, which should contribute and guarantee compliance with their purpose and tasks through such an important procedural means as procedural terms.
